Terms of service

These Terms and Conditions apply to all sales made on our website, unless we state otherwise, they do not apply to any purchases you make from authorized ZETERE retailers or other outlets - those retailers will have their own terms and conditions of sale.

 

Who We Are

ZETERE™ and www.zeterehome.com are an e-commerce service operated by ZETERE LLC., referred to as, "ZETERE", "we", "us" or "our" in this agreement.

If you purchase your items ONLINE, the seller is ZETERE LLC., whose registered office is 626 Wilshire Blvd, Suite 410, Los Angeles, CA 90017. In general, to contact us, you should do so via info@zeterehome.com  

 

Eligibility and Personal Details

For online sales, you promise to keep your login details secure and not give them to anybody else. You must notify us immediately if you think there has been a breach of security or unauthorized use of your account.

We do not guarantee that you will be able to make online purchases in all countries, or that we will accept all payment cards.

 

Privacy

You acknowledge and agree to be bound by the terms of our privacy policy effective from March 2023 in accordance with the General Data Protection Regulation (GDPR). See our Privacy Policy for how we may use your personal information.

 

How the Contract for Sale is Formed

Your order constitutes an offer to ZETERE that you will buy the merchandise. All orders are subject to acceptance by us. Our online sales procedure is intended to make available for sale only those items we have in stock and items for delivery to countries in the drop-down menu. If there is any discrepancy between the sales procedure and these terms and conditions of sale, these terms and conditions take precedence. Not all items advertised on our web site are available for sale online. Items in your shopping basket are not necessarily secure and may be purchased by other customers. We will confirm receipt of your order (Order Confirmation Receipt) but the contract will not be formed until we have checked availability and actually dispatched the order to you. We will send you a Dispatch Confirmation when the order has been dispatched to you. The Dispatch Confirmation serves to confirm that the contract has been formed and advises you of the delivery details. This legally binding contract between us, is concluded in California, United States and the language of the contract is English.

If you do not receive an Order Confirmation Receipt within 24 hours of placing your order, or you do not receive a Dispatch Confirmation within 7 days of placing your order, you should contact our online sales staff at customerservice@zeterehome.com

We take care to ensure that the colors of items you see on our web site give an accurate representation of the color of the item. However, computer monitors vary and there may be some distortion in transmission so we cannot guarantee that the color you see on your computer screen will be completely accurate.

Ownership of any items you have agreed to buy from us will pass to you at the latter of the time you take delivery of the items or the time you pay for them in full. We do not normally give customers items “on approval” or allow them to take possession of merchandise before it is paid for in full. 

 

Price, Taxes, Payment and Delivery

We try to ensure that all our advertised prices are accurate, but errors may sometimes occur. If we discover an error in the price of an advertised item or an item you have ordered, we will contact you as soon as possible. You will have an option to reconfirm your order at the correct price or to cancel it.

You may pay for your merchandise by credit card, debit card, PayPal, Klarna, Shop pay, Google Pay, Apple Pay or bank transfer.

For online sales we will arrange for delivery to the delivery address, but we and our agents reserve the right to delay or decline delivery to any address for security or other reasons. If delivery cannot be made at your chosen address, we will ask you to provide an alternative address. Where delivery times and dates are given, they are for general guidance only and we will not be held liable for late delivery of goods caused by circumstances beyond our reasonable control. Under no circumstances will we ship any items if we have not received full payment for the price of the goods that you have ordered on the Sites.

We take reasonable care to keep details of your order and payment secure, but third parties are necessarily involved in processing your card information. In the absence of negligence by ZETERE, we will not be liable for any loss you suffer for unauthorized access to any data you provide us when ordering from our web site.

 

Cancellations

ZETERE reserves the right to cancel the contract between you and us if we

• do not have sufficient stock to deliver goods you have ordered.
• do not deliver to your area; or
• if one or more items you ordered were listed at an incorrect price due to a typographical error.

Many jurisdictions give you the right to cancel your order and return items for a short period after you have received them. In the United States, this period is 7 days. Where you bought online via www.zeterehome.com, we will honor any such period which is effective in the jurisdiction we delivered your merchandise to. In order to cancel your online order under applicable law, you must email us at customerservice@zeterehome.com, using the subject heading “Order Cancellation” with your order number included. If you cancel under applicable law (where it is available) we will give you a full refund. Except where otherwise required by applicable law, we will not accept items returned if they are used or damaged or returned without their original packaging, or if the sale was not an online sale.

In some jurisdictions you may be entitled to cancel online orders if they are not delivered to you within a defined or reasonable time from placing your order, and you have not agreed to a specific delivery date. In the United States, the defined period is 7 days (unless you have agreed something else with us). We will try to get your order to you as soon as possible and we will honor any law applicable in the jurisdiction the merchandise is intended to be delivered to, that gives you the right to cancel for delayed delivery. If you wish to cancel under this law, email us at customerservice@zeterehome.com, using the heading “Order Cancellation” with your order number included. If you cancel under this law (where it is available) we will give you a full refund.

  

United States Returns (Online Purchase)

We offer all US online customers the opportunity to return unwanted items to us for online store credit, exchange or a full refund (excluding taxes). If you choose to opt for online store credit, please note that you must use the online credit note within 6 months from the date of the original purchase.

Items must be returned within 7 days of the delivery date to our Los Angeles address:626 Wilshire Blvd, Suite 410, Los Angeles, CA 90017. Items must be returned unused and in their original condition, with original packaging.

Liability

If any products we deliver to you are damaged, defective, of an incorrect quantity or not what you ordered, we shall have no liability to you unless you notify us by e-mail of the problem within 7 working days of the delivery of the products. If you notify us of a problem, our obligation will be to either,

1. To make good any shortage or no-delivery
2. To replace any goods that are damaged or defective
3. To refund you the amount paid by you for the goods in question in whatever way we choose.

  

Intellectual Property Rights

You agree and acknowledge that all designs, logos, copyright, trademarks and all other intellectual property and material rights relating to the Content of this Site, shall remain at all times with the Sites, unless otherwise stated.

Such Content, including third party trademarks and copyrights displayed or mentioned on the Sites are protected by national or international property and other laws.

You are only permitted to use the Content as authorized in written by ZETERE. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties.

  

Pricing And Payment

The prices payable for goods that you order are as set out on our website. All of our prices are in US dollars, you will be billed in US dollars. Payments will be debited and cleared from your account upon receipt of your order by ZETERE. If the issuer of your payment card or method refuses to authorize payment to ZETERE, we will not be liable for any delay or non-delivery.

 

Legal Governance

Each and every transaction carried out is deemed to be completed within California, US and therefore shall be governed by and interpreted in accordance with US California Law.

The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with US California Law and the California Courts shall have exclusive jurisdiction in relation thereto.

 

Authenticity Guarantee

We guarantee the authenticity of all products purchased through the Website.

 

Events Beyond Our Control

We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

 

Copyrights, Trademarks & Commercial Use

You agree and acknowledge that all materials including photographs, images, illustrations, designs are part of the Sites and are protected by copyright, trademark and/or other intellectual property rights owned, controlled or licensed to ZETERE. The contents of the site and the site as a whole are intended solely for personal, non-commercial use. You may download or copy the contents and other downloadable materials displayed on the site for the sole purpose of placing an order with ZETERE or using the site as a shopping resource. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the contents, the site, or any related software. 

  

General

We may change these terms and conditions at any time but once you have purchased an item, the terms and conditions current at the time of your purchase will apply.

If any of these terms and conditions is invalid or unenforceable, the remainder will continue to have full force and effect.

These terms and conditions will not be binding on our assignees or successors unless they adopt these terms and conditions or they are affiliated with ZETERE.

If we breach these terms and conditions, we will be liable only for your direct losses and the reasonably foreseeable consequences of our breach.

Our liability is limited to the price you paid for the goods purchased from us.

We will not be responsible to you for any delay or failure to comply with our obligations if the delay or failure arises from any cause beyond our reasonable control.

We do not seek to limit our liability for death or personal injury arising from our negligence, or to exclude liability for fraudulent misrepresentation by ourselves or our agents.
